TERMS AND CONDITIONS

Welcome to Dickyways Tours and Travel Limited. Please read these Terms and Conditions carefully before booking any safari, city tour, excursion, or corporate travel service with us. By paying a deposit or confirming an itinerary, you agree to be bound by the terms outlined below.

1. Definitions and Interpretation

  • “Company,” “We,” “Us,” or “Our” refers to Dickyways Tours and Travel Limited.

  • “Client,” “You,” or “Your” refers to the individual, group, family, or corporate entity booking travel services.

  • “Services” refers to wildlife safaris, urban city tours, culinary/agro-tourism, mountain climbing, beach getaways, car hire, airport transfers, hotel bookings and corporate team-building packages.

2. Bookings, Deposits, and Payments

To secure your custom-curated itinerary, luxury lodge selection, or adventure package, the following payment terms apply:

  • Booking Deposit: A deposit of 50% of the total quotation amount is required to secure reservations for accommodations, transport and flight transfers.

  • Final Balance: The remaining 50% balance must be paid in full at least 30 days prior to the scheduled tour departure date.

  • Last-Minute Bookings: Bookings made within 30 days of departure must be paid in full at the time of confirmation.

  • Pricing Integrity: In alignment with our core value of Integrity & Transparency, all prices are competitive and feature no hidden costs. However, we reserve the right to adjust prices should there be external changes to park entry fees, government levies or severe fuel fluctuations.

3. Cancellation and Refund Policy

All cancellation requests must be submitted in writing via email to info@dickywaystoursandtravel.com. Because we commit funds to third-party providers (luxury lodges, national parks and chartered flights), cancellations incur the following charges:

  • 60 days or more before departure: Full refund minus bank processing charges and non-refundable deposit components.

  • 30 to 59 days before departure: 25% of the total tour cost is forfeited.

  • 15 to 29 days before departure: 50% of the total tour cost is forfeited.

  • 0 to 14 days before departure (or No Show): 100% of the total tour cost is forfeited.

Special Note: Payments made for specific conservation permits, hot air balloon safaris, or premium seasonal lodge blocks (such as peak Great Migration bookings in the Maasai Mara) are subject to the strict non-refundable policies of those respective third-party providers.

4. Itinerary Changes and Flexibility

  • By the Client: We specialize in Bespoke Travel Experiences. If you wish to amend your tailored itinerary post-confirmation, we will make every effort to accommodate your schedule, subject to availability and additional third-party costs.

  • By the Company: While we strive for flawless execution, African travel conditions can be unpredictable. We reserve the right to adjust travel routes, safari tracks, or accommodations due to sudden weather disruptions, safety factors, or park regulations (e.g., flash floods in Hell’s Gate or river conditions in the Mara). An equivalent standard of comfort and service will always be maintained.

5. Passports, Visas, and Health Requirements

  • Travel Documents: It is the client’s sole responsibility to ensure they hold a valid passport (minimum 6 months validity from the travel date) and possess the correct visas or Electronic Travel Authorizations (eTA) for entry into Kenya or surrounding countries.

  • Health & Vaccinations: Clients must verify and fulfill all health and vaccination mandates (e.g., Yellow Fever certifications, Malaria prophylactics) required for specific wilderness or rural destinations.

  • Travel Insurance: We strongly mandate that all clients purchase comprehensive travel insurance covering emergency medical evacuation, trip cancellation, injury and loss of personal baggage before embarking on any safari.

6. Safety, Inherent Risks, and Liability

  • Adventure Activities: Wildlife safaris, mountain climbing (Mount Kenya), gorge hiking, cycling and coastal water sports are exhilarating but carry inherent risks involving wild animals and rugged terrains.

  • Limitation of Liability: While Dickyways partners exclusively with reputable hotels and enforces strict safety standards with well-maintained vehicles, the Company cannot be held liable for personal injury, illness, delay or property loss resulting from force majeure or natural wildlife behavior.

  • Valuables: Clients are responsible for safeguarding their cameras, tech devices and personal valuables throughout the duration of the tour.

7. Sustainability, Cultural Respect, and Conduct

As an organization dedicated to Sustainability & Responsible Tourism, we require our clients to adhere to the following during tours:

  • Strictly follow the safety and environmental instructions provided by our professional tour guides.

  • Respect wildlife by keeping recommended distances, avoiding littering, and refraining from feeding animals in national parks.

  • Maintain cultural sensitivity and respect local customs during immersive village and community visits (e.g., Maasai, Samburu, Luo, or Njemps communities).

  • The Company reserves the right to terminate the tour of any client whose behavior is deemed illegal, hazardous, or severely disruptive to other travelers or local communities.

8. Governing Law and Dispute Resolution

Any dispute or claim arising out of our services shall be handled with immediate care by our 24/7 client support line. If an issue cannot be resolved amicably on the ground, formal complaints must be lodged in writing within 14 days of tour completion. These terms are governed by and construed in accordance with the laws of the Republic of Kenya.
